A judge granted Olivier Martinez a temporary restraining order Thursday in an escalating custody dispute with actress Halle Berry, who faces allegations of physically abusing their 12-year-old son, Maceo.
The temporary restraining order requires Berry to maintain a distance of 100 yards from Martinez and limits her to court-ordered visitations of two days per week and alternating weekends until an October 16 hearing.
Martinez filed court documents alleging that on September 26, Berry entered their son's room while Maceo was wearing virtual reality goggles and playing a game. According to Martinez's account, Berry called the boy "stupid," then jumped on him, grabbed his neck and choked him while asking, "Who is dominant now?" Martinez said Maceo contacted him after the incident to report the attack and that Berry's fiancé, Van Hunt, was present in the home.
Beyond the specific incident, Martinez alleges a pattern of abuse spanning years, including physical attacks, verbal harassment and emotional mistreatment directed at both Maceo and himself. The petition also requests that Berry submit to sobriety testing before, during and after any visits with their son.
Berry's attorney, Marina Beck, moved swiftly to contest the allegations. In a statement to Fox News Digital, Beck characterized the filing as "entirely meritless and deliberately misleading." She pointed to what she described as a "voluminous" record of evidence and prior judicial rulings showing that Martinez has repeatedly violated court orders and interfered with therapeutic and educational interventions for Maceo.
Beck's response framed Martinez's conduct as part of a broader pattern, stating: "In a way, today's filing is not entirely unexpected from an individual with a well-documented history of erratic, possessive and violent behavior." She said Berry remains committed to Maceo's welfare.
The couple's custody and financial arrangements were finalized in 2023, eight years after their separation. Under the settlement, Berry pays nearly $8,000 monthly in child support and an additional 4.3% of income exceeding $2 million. She also bears full responsibility for Maceo's private school tuition, extracurricular activities and healthcare expenses.
Two years ago, Berry had sought sole custody of Maceo, citing what she characterized as Martinez's "turbulent and detrimental behavior" toward therapeutic and educational interventions she had arranged for their son.
Berry also has an 18-year-old daughter, Nahla Ariela Aubry, from a previous relationship with Gabriel Aubry.
